Privacy Policy

1. Who We Are and Who This Policy Covers

InfluencerGo LLC is the data controller responsible for personal information processed through the InfluencerGo platform. This Policy applies to all individuals who access or use the Platform in any capacity, including approved creator accounts, applicants, website visitors, and any individual whose data is submitted to or processed by the Platform.

2. Information We Collect

2.1 Information You Provide Directly

• Account information: Full legal name, display name, email address, phone number, residential address, date of birth, and profile photograph.
• Identity and tax documentation: Government-issued identification, Social Security Number or Employer Identification Number, and documentation required for KYC verification and tax compliance, including IRS Form W-9 information.
• Financial information: Bank account details, payment method information including Venmo, CashApp, PayPal, and similar services. We do not store full payment credentials — these are transmitted directly to our payment processors.
• AI likeness and voice data: Video footage, audio recordings, and photographs you voluntarily upload for AI content generation features. This data is subject to a separate, explicit consent process.

2.2 Information Collected Automatically

• Device and browser data: IP address, browser type, operating system, device identifiers, screen resolution, installed fonts, hardware configuration, and timezone — collected for fraud prevention and security purposes.
• Device fingerprinting: We employ advanced device fingerprinting technology including browser canvas fingerprinting and WebGL fingerprinting through our fraud prevention partner FingerprintJS Pro. This data is used exclusively for account security and fraud detection.
• Transaction data: Records of all promotional activity, promo code usage, conversion events, and earnings calculations.

2.3 Information From Third Parties

• Social platform data: When you connect social media accounts through our integration partner Phyllo, we receive publicly available profile data, follower counts, engagement metrics, audience demographic information, and content performance data.

3. How We Use Your Information

• Creating and maintaining your account and verifying your identity
• Calculating and processing commission earnings and payouts
• Detecting, investigating, and preventing fraud, abuse, and violations of our Terms
• Generating and maintaining device blacklists to prevent re-registration by prohibited users
• Complying with applicable laws, including tax reporting obligations (IRS Form 1099-NEC)
• Sending operational communications including payout notifications and account alerts
• Generating AI content using your voluntarily submitted likeness and voice data, subject to explicit consent

We do not sell your personal information. We may share your information with service providers who process data on our behalf, with legal authorities when required by law or court order, and in connection with a merger or acquisition. We do not share your personal contact information with brand partners without your explicit consent.

6. Data Retention

• Active account data: retained for the life of your account plus five (5) years following closure
• Financial and tax records: minimum seven (7) years as required by law
• Fraud prevention data associated with banned accounts: retained indefinitely
• AI likeness and voice data: deleted within thirty (30) days of written consent revocation

7. Your Rights

Depending on your jurisdiction, you may request access to, correction of, or deletion of your personal data. You may also revoke AI likeness consent at any time, which results in deletion of generated content within thirty (30) days. To exercise any right, contact privacy@influencergo.com. We respond within forty-five (45) days.

8. Children's Privacy

The Platform is intended exclusively for individuals aged eighteen (18) and older. We do not knowingly collect personal information from minors. Discovery of a minor account results in immediate deletion and account closure.

9. Security

We implement industry-standard security measures including TLS 1.3 encryption in transit, encryption at rest for sensitive data, and regular security audits. You are responsible for maintaining the security of your account credentials.

10. California Privacy Rights (CCPA/CPRA)

California residents have additional rights under the CCPA/CPRA including the right to know, delete, and opt out of sale (we do not sell personal data). Submit California privacy requests to privacy@influencergo.com with subject line "California Privacy Request."

11. Changes to This Policy

Material changes will be communicated via email and through a prominent Platform notice. Continued use following such notice constitutes acceptance of the revised Policy.
